Ken’s Korner: EBay in legal battle with MercExchange – The Journal of Antiques and Collectibles – June 2006
Online auction giant eBay is involved in a bitter patent dispute with a much smaller company called MercExchange. The battle is over eBay’s “Buy It Now” feature, which allows items to be sold at a fixed price. The courts decided that a patent held by MercExhange had been violated by eBay. But for technical reasons of patent law, plus policy reasons, the higher courts are expected to rule in eBay’s favor. EBay says the patent should never have been issued to MercExchange to begin with.
